Conditions:

Walleye action is still good to excellent on the west side from Walnut Creek to the Ohio line in 15 to 40 feet of water. Plugs, stick baits, and crawler harnesses have all been working well off of planer boards or just flat lining in the shallower water. In the deeper depths, the small cookie size Dipseys have been popular. The perch are starting to school heavily and limits are becoming conmon. Perch are schooling in the usual popular locations in 45 to 50 feet of water north of Walnut Creek and off the point at Presque Isle. Current Lake Erie water temperatures off Toledo are 68 degrees, off Cleveland, 67 degrees and off the Port of Erie, 69 degrees.

Temporary Closing on Presque Isle Bay:

On Saturday June 28th, the west end of Presque Isle Bay will be closed to boat and angler traffic. The restricted area is roughly from the Erie Yacht club north to the Vista 3 boat launch near the Stull Interpretive Center. The closed off area will be clearly marked.

On Saturday, June 28, 2008 a historic event will take place in Erie to mark the achievement of a goal that was set in 1988.A Swimmable Bay in Twenty Years. Thanks to the efforts of many, the water quality in Presque Isle Bay has greatly improved since 1988 and the goal has been achieved. To celebrate, a coalition of organizations is sponsoring BaySwim---a one-mile swim across the bay.

Swimmers are required to register for this one-time event. But don't wait. BaySwim will be limited to 300 registered swimmers. Unregistered swimmers will not be permitted to participate in this event. Entrants must be at least 14 years old on the date of BaySwim to participate.

BaySwim will begin on Presque Isle State Park on the north shore of Presque Isle Bay at the Vista 3 Boat Launch near Stull Interpretive Center. A well-marked, guarded course will mark the route to the finish on the south shore of the bay at the Erie Yacht Club.

All BaySwim entrants will be required to check-in at Vista 3 on June 28 between 7:15-8:15 AM. Entrants will receive an official BaySwim swim cap and final instructions at that time.

BaySwim will begin at 9:00 AM and all swimmers will be out of the water by 11:00 AM.

Swimmer safety is of primary importance. Organizers have arranged to have safety-staffed anchored boats, kayaks and runabouts to line the entire one-mile BaySwim course. The U.S. Coast Guard and the Pennsylvania Fish and Boat Commission have issued permits for the event.

The Law and Building Open Fires:

It is a violation of the law to build a fire anywhere in the Commonwealth of PA. without expressed land owner permission or by area specific laws or ordinances. A number of complaints have been received of fires built with out permission, especially along the Lake front shore line. Nearly all land including the the Lake Front properties are owned by someone and simply put, building a fire without land owner permission can result in a fine.

Reporting Requirements for Chartered Fishing Vessels Arriving in U.S. along Lake Erie Shore

WHEN REPORTING IS REQUIRED

Masters must report their arrival to U.S. Customs and Border Protection if having been engaged in any of the below activities:

Ø After having been at any foreign port or place including tying up at a foreign dock or;

Ø When any boat or crew has come into contact with any vessel coming from foreign.

The simple activity of fishing in Canadian waters will not require reporting arrival to Customers and Boarder Protection.

Ø There are four exceptions to the face-to-face inspection at a designated reporting location:

NEXUS
Canadian Border Boat Landing Permit (I-68)
Outlying Arca Reporting Stations (OARS),
Ø Any Passenger of a Charter Vessel that does not disembark at a foreign port or place will not be required to report at a designated reporting location. In this instance, the Master/Captain or a Charted Vessel will be allowed to report the arrival of his/her passengers into the United States.

Ø Participation in any of the programs does not preclude the requirement for physical reporting upon request by U.S. Customs and Border Protection.

REPORTING PROCEDURE

U.S. Customs and Border Protection encourage the Master/Captain of a Charter Vessel to enroll in the "Canadian Border Boat Program" for issuance of an I-68 permit or the NEXUS Program. The NEXUS Card of the I-68 permit will allow the Master/Captain of a Chartered Vessel to report the arrival of the vessel's crew and passengers to CBP. The Master/Captain is required to report their arrival by telephoning CBP.

If the Master/Captain are not enrolled in either the I-68 Program or NEXUS Program, they will be required to present themselves for face-to-face inspection or at any of the Outlying Arca Reporting Stations (OARS) where they may also report the arrival of their crew and passengers.

OARS sites are located at 12 locations along the south short of Lake Erie.

WHERE TO REPORT

Reports of arrival may be made at any of the following ports of entry. Upon report of arrival to U.S. Customs and Border Protection Officer will provide further instructions regarding designated reporting locations and entry processing. The boat must be made available for possible boarding at the time of the report.

Physical in-person reporting can be done by calling in advance one of the following Ports of Entry (during normal duty hours):

The hours are Monday through Friday 0800 - 1700 and on Saturday and Sunday 1000 - 1800 (except for Toledo, which is closed on weekends). The boat must be made available for inspection and boarding by CBP officers.

Ø NEXUS

NEXUS Marina program is a join Canada-U.S. initiative that offers facilitated customs and immigration clearance for recreational low-risk boaters entering either country through registration into the program. NEXUS is valued for 5 years and satisfies the boat operator's legal requirement to report to a port-of-entry for face-to-face inspection in accordance with 8 CFR 235.1, but boaters must still phone in their arrival to satisfy 19 USC 1433.

Ø Canadian Border Boat Landing Permit (I-68)

Canadian Border Boat Landing Permit (I-68) applicants for admission into the United States by small pleasure boats are inspected and issued an I-68 permit for the entire boating season. The I-68 permit allows boaters to enter the United States from Canada for recreational purposes with only the need to report to CBP by telephoning in their arrival.

Ø Outlying Area Reporting System (OARS)

OARS is another northern border method for boaters to report entry to satisfy 19USC and 8CFR requirements into the United States from Canada. The OARS program uses videophones, typically located at public marinas, which boaters may use to report to CBP.

FAILURE TO REPORT

Failure to report can result in civil penalties as defined in Title 19, United States Code, Section 1436 to include a penalty of $5,000 for the first violation and $10,000 for each subsequent violation with the conveyance subject to seizure and forfeiture. In addition to being liable for a civil penalty, any master who intentionally commits a violation under subsection (a) of this section upon conviction is liable for a fine of not more than $2,000 or imprisonment for 1 year or both.
